Agreement
These Terms of Use (“Terms”) govern your access to Fragile Labs websites, accounts, Fit, Sunday Money, Fragile Admin, and any other service that links to them (together, the “Services”). By creating an account, accepting an invitation, purchasing access, or using a Service, you agree to these Terms and our Privacy Policy. If you use a Service for a gym, household, or other organization, you represent that you have authority to act for it when your actions purport to bind it.
Eligibility and accounts
You must be able to form a binding contract where you live. Sunday Money and financial-account connections are limited to adults. A person age 13 or older may use Fit with permission and oversight from a parent or legal guardian. You must provide accurate account information, protect credentials and recovery codes, and promptly report unauthorized use. You are responsible for activity performed through your account unless caused by our failure to use reasonable security.
Product access and organizations
A Fragile Labs account does not automatically include every product. Access may come from an individual subscription, a gym or organization, a household membership, a promotion, or an administrative grant. Roles determine what you may do inside a particular gym or household.
If a gym or organization pays for your access, it may manage your membership and role and may end sponsored access. If that happens, your account may remain available but continued product access may require an individual subscription. Household and organization owners are responsible for authorizing members and maintaining appropriate permissions.
Subscriptions and payment
Prices, billing periods, trial terms, and renewal details are shown before purchase. Unless stated otherwise, paid subscriptions renew automatically until canceled. You authorize the applicable payment provider to charge the displayed amount and taxes. Cancel before the renewal date to avoid the next charge. Cancellation normally stops future renewal and access continues through the paid period unless law or the purchase terms require otherwise. Refunds are provided when required by law or expressly stated at purchase. App-store purchases are also governed by that store’s billing and refund rules.
Fit is not medical care
Fit provides tracking, planning, gym, coaching, and informational tools. It does not provide medical diagnosis, treatment, emergency services, or a substitute for a qualified health professional. Exercise involves risk. Consult an appropriate professional before beginning or changing a program, particularly if you have an injury, medical condition, or concerning symptoms. Stop and seek appropriate help if an activity causes pain, dizziness, breathing difficulty, or other warning signs. Coaches and gyms are independent of Fragile Labs unless explicitly stated otherwise.
Sunday Money is not financial advice
Sunday Money is a household organization and budgeting tool. It is not a bank, payment processor, accountant, investment adviser, credit bureau, or fiduciary and does not provide tax, legal, credit, or investment advice. Connected-account data may be delayed, incomplete, duplicated, categorized incorrectly, or unavailable. Verify important information with your financial institution and a qualified professional. Never rely on Sunday Money alone to determine an account balance, payment deadline, tax obligation, or investment decision.
Your content and shared data
You retain ownership of information you enter or upload. You give Fragile Labs a limited license to host, process, copy, transmit, and display it only as needed to operate, secure, support, and improve the Services and comply with law. You represent that you have the right to provide the content.
Information entered into a gym or Sunday Money household may be visible to other authorized members. Do not add another person’s sensitive information without permission. Removing your account may not delete information owned or needed by a shared organization or household, although we will remove or deidentify your personal information where required.
Acceptable use
You may not:
- Break the law, infringe rights, harass people, or upload malicious or deceptive material.
- Access another account, gym, household, or data without authorization.
- Bypass access controls, probe the Services outside our responsible research rules, disrupt availability, or introduce malware.
- Scrape, resell, sublicense, or use the Services to build a competing identity, fitness, or finance dataset except as allowed in writing.
- Reverse engineer the Services except where that restriction is prohibited by law.
- Use automated activity that materially burdens the Services or interferes with others.
Third-party services
The Services may interact with Stripe, Plaid, Apple, Google, financial institutions, gyms, and other third parties. Their services and data are governed by their own terms and privacy practices. Fragile Labs is not responsible for a third party’s independent acts, availability, or content, but this does not limit responsibility that cannot legally be excluded.
Service changes and termination
We may add, change, suspend, or discontinue features. We will use reasonable efforts to provide notice when a material change affects paid access. You may stop using the Services at any time. We may suspend or terminate access for a material or repeated violation of these Terms, security risk, fraud, nonpayment, legal requirement, or harm to another person or the Services. Where practical, we will provide notice and an opportunity to correct the issue.
Ownership and feedback
Fragile Labs and its licensors own the Services, software, branding, and related intellectual property, excluding your content. Subject to these Terms, we give you a personal, limited, revocable, nonexclusive, nontransferable right to use the Services. If you send feedback, you allow us to use it without restriction or compensation.
Disclaimers
To the fullest extent allowed by law, the Services are provided “as is” and “as available.” We do not promise uninterrupted operation, error-free data, a particular fitness result, financial outcome, or permanent availability of a feature. We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement. These disclaimers do not override rights that cannot be waived under applicable law.
Limitation of liability
To the fullest extent allowed by law, Fragile Labs will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or lost profits, revenue, data, goodwill, or opportunities arising from the Services. Our aggregate liability for a claim will not exceed the greater of $100 or the amount you paid Fragile Labs for the affected Service during the twelve months before the event giving rise to the claim. This limit does not apply where prohibited by law or to liability that cannot legally be limited.
Governing law and disputes
These Terms are governed by Colorado law, without regard to conflict-of-law rules. Before filing a claim, you and Fragile Labs agree to try to resolve it informally for 30 days after written notice. Unless applicable law requires otherwise, claims must be brought in the state or federal courts located in Colorado, and each party consents to those courts. Nothing here prevents either party from seeking urgent injunctive relief or using an eligible small-claims court.
Changes and contact
We may update these Terms. Material changes will apply prospectively, and we will provide reasonable notice through the Service or email when appropriate. Continued use after the effective date means you accept the updated Terms. If you do not agree, stop using the Services and cancel paid access. Questions can be sent to [email protected].
